Please read these Terms of Service ("Terms") carefully before using the Pheme iOS application ("App"). By downloading or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Pheme, you confirm that you are at least 13 years of age and agree to these Terms. If you do not agree, please do not use the App.

2. Description of Service

Pheme is a third-party iOS client for Mastodon, a decentralized, open-source social network. Pheme provides an interface to access and interact with Mastodon instances. We are not affiliated with or endorsed by Mastodon gGmbH or any Mastodon instance operator.

3. User Responsibilities

You are solely responsible for:

Complying with the terms of service of the Mastodon instance you connect to
All content you post, share, or interact with through the App
Maintaining the security of your account credentials
Any activity that occurs through your account

4. Pheme Pro Subscription

Pheme offers an optional premium subscription ("Pheme Pro") that unlocks additional features.

Subscriptions are billed through your Apple ID via the App Store (weekly, monthly, or yearly plans).
Payment is charged to your Apple ID account upon confirmation of purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions).
No refunds are provided for unused portions of a subscription period, except as required by applicable law.
We reserve the right to modify, suspend, or discontinue any feature of Pheme Pro at any time with reasonable notice.

5. Intellectual Property

Pheme and its original content, features, and functionality are owned by us and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works based on the App without our prior written consent.

6. Third-Party Services

Pheme connects to third-party Mastodon instances and uses Apple's frameworks (including StoreKit and APNs). We are not responsible for the availability, content, or practices of any third-party service. Use of third-party services is subject to their respective terms and privacy policies.

7. Disclaimer of Warranties

Pheme is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App. Our total liability for any claim related to the App shall not exceed the amount you paid for Pheme Pro in the 12 months preceding the claim.

9. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes by updating the effective date above. Continued use of the App after changes constitutes your acceptance of the revised Terms.

10. Termination

We reserve the right to suspend or terminate your access to Pheme at our discretion, without notice, if we believe you have violated these Terms.
